By booking, reserving, or using any transportation service provided by Black Elegant Transportation, you ("the Client") agree to be bound by these Terms and Conditions in their entirety. These terms apply to all services including but not limited to wedding transportation, airport transfers, prom transportation, corporate transportation, sports and event transportation, Kentucky Derby transportation, concert transportation, and all other services offered by Black Elegant Transportation.
If you do not agree to these terms, please do not proceed with a booking. Black Elegant Transportation reserves the right to update or modify these terms at any time without prior notice. The most current version of these terms will always be available at blackeleganttransportation.com/terms.
A deposit is required to confirm and secure all reservations. No reservation is considered confirmed until a deposit has been received by Black Elegant Transportation. Vehicle availability is not guaranteed until a deposit is paid and a confirmation is issued.
Deposit amounts vary by service type, vehicle, date, and duration. The deposit amount will be communicated to the Client at the time of booking. The remaining balance is due prior to or on the date of service as agreed upon at the time of booking.
All deposits for wedding and event transportation are non-refundable unless otherwise stated in writing by Black Elegant Transportation at the time of booking.
A booking confirmation will be sent to the Client via email or text message upon receipt of the deposit. It is the Client's responsibility to review the confirmation for accuracy and notify Black Elegant Transportation of any errors within 24 hours of receipt.

To qualify for a full refund, the cancellation request must be received by Black Elegant Transportation at least 48 hours before the scheduled pickup time via phone call or text to (636) 306-3058 or email to [email protected]. The time and date of the cancellation request will be recorded and used to determine eligibility.
Due to the high demand and limited availability of Derby weekend transportation, all Kentucky Derby deposits are non-refundable. Cancellations made 48+ hours before the scheduled service may be eligible for a credit toward a future booking at the sole discretion of Black Elegant Transportation.

Cancellations must be confirmed in writing via text or email to be valid. Verbal cancellations without written confirmation will not be accepted.
The Client is fully responsible for any and all damage caused to Black Elegant Transportation vehicles by the Client, passengers, or any individuals associated with the Client's reservation during the duration of the service. This includes damage to the interior, exterior, equipment, fixtures, upholstery, electronics, and any other component of the vehicle.
In the event of damage to a vehicle, Black Elegant Transportation will assess the damage and provide the Client with a written estimate of repair costs. The Client agrees to pay all assessed damage costs in full within 7 days of receiving the damage assessment.
Black Elegant Transportation reserves the right to charge a damage deposit at the time of booking for certain events or vehicle types. This deposit will be returned to the Client within 5โ7 business days following the completion of service, provided no damage has occurred.
Black Elegant Transportation reserves the right to charge the Client's payment method on file for any damage costs incurred during the service. By booking with Black Elegant Transportation, the Client authorizes Black Elegant Transportation to charge the payment method on file for any damage costs up to the full replacement value of the damaged item or vehicle component.
Black Elegant Transportation is not responsible for any personal property left in vehicles. Clients are advised to check the vehicle for personal belongings before exiting. Black Elegant Transportation will make reasonable efforts to return found items but assumes no liability for lost, stolen, or damaged personal property.
The $250.00 cleaning fee covers the cost of professional deep cleaning, sanitization, deodorization, and any lost revenue resulting from the vehicle being taken out of service for cleaning. This fee applies regardless of the severity of the incident.
If the damage caused by vomiting or biohazard contamination exceeds the standard $250.00 cleaning fee โ including but not limited to damage to upholstery, carpeting, or other vehicle components โ the Client will be responsible for all additional costs beyond the base cleaning fee.
By booking with Black Elegant Transportation, the Client authorizes Black Elegant Transportation to charge the payment method on file the $250.00 cleaning fee immediately upon the occurrence of any vomiting or biohazard incident during the service.
All passengers are expected to conduct themselves in a respectful, lawful, and responsible manner at all times while in a Black Elegant Transportation vehicle. Black Elegant Transportation reserves the right to terminate service immediately and without refund if any passenger engages in behavior that is deemed unsafe, illegal, disrespectful, or damaging to the vehicle or chauffeur.
Alcohol consumption is permitted in Black Elegant Transportation vehicles only by passengers who are 21 years of age or older and only in accordance with applicable state and local laws. Black Elegant Transportation reserves the right to refuse service to any passenger who appears to be excessively intoxicated or whose behavior poses a risk to the safety of other passengers, the chauffeur, or the vehicle.
Black Elegant Transportation vehicles may not be used for any illegal activity. The chauffeur is authorized to terminate service immediately and contact law enforcement if any illegal activity is suspected or observed. No refund will be issued in such cases.
The number of passengers in any vehicle must not exceed the stated maximum capacity of that vehicle at any time. Black Elegant Transportation reserves the right to refuse additional passengers beyond the stated vehicle capacity for safety and legal compliance reasons.
Black Elegant Transportation makes every effort to ensure on-time arrival for all scheduled pickups. However, Black Elegant Transportation is not liable for delays caused by traffic, weather, road closures, accidents, mechanical issues, or any other circumstances beyond our reasonable control.
Black Elegant Transportation reserves the right to substitute a vehicle of equal or greater value in the event that the reserved vehicle becomes unavailable due to mechanical issues, accidents, or other unforeseen circumstances. The Client will be notified of any substitution as soon as possible prior to the scheduled service.
The chauffeur will follow the most efficient route to the destination unless specific routing instructions are provided by the Client at the time of booking. Additional stops or route changes requested during service may result in additional charges based on time and mileage.
If the service extends beyond the reserved time, overtime charges will apply at the agreed hourly rate. The Client will be notified by the chauffeur before overtime charges begin where possible.
Black Elegant Transportation will wait up to 15 minutes beyond the scheduled pickup time at no additional charge. Wait time beyond 15 minutes will be charged at the applicable hourly rate.
For airport pickup services, Black Elegant Transportation monitors flight arrivals and adjusts pickup times accordingly for delayed flights at no additional charge. The Client is responsible for notifying Black Elegant Transportation of any flight changes or cancellations as soon as possible.
Black Elegant Transportation accepts all major credit cards, debit cards, and other payment methods as communicated at the time of booking.
By providing payment information, the Client authorizes Black Elegant Transportation to charge the provided payment method for all agreed-upon service fees, deposits, and any applicable additional charges including but not limited to damage fees, cleaning fees, overtime charges, and wait time charges.
Any disputed charges must be communicated directly to Black Elegant Transportation within 7 days of the charge by contacting us at (636) 306-3058 or [email protected]. Black Elegant Transportation will make every reasonable effort to resolve disputes fairly and promptly.
Black Elegant Transportation's maximum liability to the Client for any claim arising from the provision of services shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.
Black Elegant Transportation shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services, including but not limited to missed flights, missed events, lost business opportunities, or emotional distress.
Black Elegant Transportation shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, severe weather, government actions, pandemics, civil unrest, or infrastructure failures.
Black Elegant Transportation is not responsible for any personal property left in or damaged while in our vehicles. Clients are solely responsible for their personal belongings at all times.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Illinois. Any disputes arising from these terms or the services provided by Black Elegant Transportation shall be subject to the exclusive jurisdiction of the courts of the State of Illinois.
By booking, reserving, or using any service provided by Black Elegant Transportation, the Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions in their entirety.
The Client further acknowledges that they have had the opportunity to seek independent legal advice before agreeing to these terms and have chosen to proceed without doing so, or have obtained such advice and are satisfied with these terms.
