Agreement to Terms

By booking, reserving, or using any transportation service provided by Black Elegant Transportation, you ("the Client") agree to be bound by these Terms and Conditions in their entirety. These terms apply to all services including but not limited to wedding transportation, airport transfers, prom transportation, corporate transportation, sports and event transportation, Kentucky Derby transportation, concert transportation, and all other services offered by Black Elegant Transportation.

If you do not agree to these terms, please do not proceed with a booking. Black Elegant Transportation reserves the right to update or modify these terms at any time without prior notice. The most current version of these terms will always be available at blackeleganttransportation.com/terms.

Reservations & Deposits

2.1 โ€” Deposit Requirement

A deposit is required to confirm and secure all reservations. No reservation is considered confirmed until a deposit has been received by Black Elegant Transportation. Vehicle availability is not guaranteed until a deposit is paid and a confirmation is issued.

2.2 โ€” Deposit Amount

Deposit amounts vary by service type, vehicle, date, and duration. The deposit amount will be communicated to the Client at the time of booking. The remaining balance is due prior to or on the date of service as agreed upon at the time of booking.

2.3 โ€” Prom Deposits

โš ๏ธ ALL PROM DEPOSITS ARE 100% FINAL โ€” NO EXCEPTIONS All deposits made for prom transportation services are 100% non-refundable and non-transferable under any circumstances. No exceptions will be made regardless of the reason for cancellation, including but not limited to illness, school cancellations, weather events, or personal emergencies. By paying a prom deposit, the Client acknowledges and agrees that the deposit is final and will not be returned under any circumstances whatsoever.

2.4 โ€” Wedding & Event Deposits

All deposits for wedding and event transportation are non-refundable unless otherwise stated in writing by Black Elegant Transportation at the time of booking.

2.5 โ€” Booking Confirmation

A booking confirmation will be sent to the Client via email or text message upon receipt of the deposit. It is the Client's responsibility to review the confirmation for accuracy and notify Black Elegant Transportation of any errors within 24 hours of receipt.

3.1 โ€” Cancellation with 48+ Hours Notice

โœ… FULL REFUND ELIGIBLE Cancellations made 48 hours or more before the scheduled pickup time are eligible for a full refund of all payments made, including the deposit, unless otherwise specified at the time of booking.

To qualify for a full refund, the cancellation request must be received by Black Elegant Transportation at least 48 hours before the scheduled pickup time via phone call or text to (636) 306-3058 or email to [email protected]. The time and date of the cancellation request will be recorded and used to determine eligibility.

3.2 โ€” Same-Day Cancellations (Less Than 48 Hours Notice)

โš ๏ธ 50% REFUND Cancellations made less than 48 hours before the scheduled pickup time are eligible for a 50% refund of the total amount paid. The remaining 50% will be retained by Black Elegant Transportation to cover vehicle reservation costs, chauffeur scheduling, and operational expenses.

3.3 โ€” No-Show Policy

โŒ NO REFUND If the Client fails to appear at the designated pickup location within 15 minutes of the scheduled pickup time without prior notice, the reservation will be considered a no-show. No refund will be issued for no-show reservations. The full amount paid will be forfeited.

3.4 โ€” Prom Cancellations โ€” NO REFUND UNDER ANY CIRCUMSTANCES

โŒ ALL PROM PAYMENTS ARE 100% FINAL All prom transportation deposits and payments are 100% final and non-refundable regardless of when the cancellation is made. The standard cancellation policy in Sections 3.1 and 3.2 does NOT apply to prom bookings. By booking prom transportation, the Client expressly acknowledges and agrees that all payments are final and no refund will be issued under any circumstances including illness, school cancellations, weather, or personal emergencies.

3.5 โ€” Kentucky Derby Cancellations

Due to the high demand and limited availability of Derby weekend transportation, all Kentucky Derby deposits are non-refundable. Cancellations made 48+ hours before the scheduled service may be eligible for a credit toward a future booking at the sole discretion of Black Elegant Transportation.

3.6 โ€” How to Cancel

To cancel a reservation, contact Black Elegant Transportation by:

Cancellations must be confirmed in writing via text or email to be valid. Verbal cancellations without written confirmation will not be accepted.

4

Vehicle Damage Policy

4.1 โ€” Client Responsibility for Vehicle Damage

The Client is fully responsible for any and all damage caused to Black Elegant Transportation vehicles by the Client, passengers, or any individuals associated with the Client's reservation during the duration of the service. This includes damage to the interior, exterior, equipment, fixtures, upholstery, electronics, and any other component of the vehicle.

โš ๏ธ IMPORTANT โ€” CLIENT LIABILITY Black Elegant Transportation will assess all damage at the conclusion of service. The Client agrees to pay all assessed damage costs in full within 7 days of receiving the damage assessment. Failure to pay may result in legal action and/or collections.

4.2 โ€” Damage Assessment

In the event of damage to a vehicle, Black Elegant Transportation will assess the damage and provide the Client with a written estimate of repair costs. The Client agrees to pay all assessed damage costs in full within 7 days of receiving the damage assessment.

4.3 โ€” Damage Deposit

Black Elegant Transportation reserves the right to charge a damage deposit at the time of booking for certain events or vehicle types. This deposit will be returned to the Client within 5โ€“7 business days following the completion of service, provided no damage has occurred.

4.4 โ€” Authorization to Charge for Damages

Black Elegant Transportation reserves the right to charge the Client's payment method on file for any damage costs incurred during the service. By booking with Black Elegant Transportation, the Client authorizes Black Elegant Transportation to charge the payment method on file for any damage costs up to the full replacement value of the damaged item or vehicle component.

4.5 โ€” Personal Property

Black Elegant Transportation is not responsible for any personal property left in vehicles. Clients are advised to check the vehicle for personal belongings before exiting. Black Elegant Transportation will make reasonable efforts to return found items but assumes no liability for lost, stolen, or damaged personal property.

Vomit & Biohazard Cleaning Fee

Mandatory Vomit / Biohazard Cleaning Fee

5.1 โ€” Cleaning Fee

โš ๏ธ $250.00 MANDATORY CLEANING FEE A mandatory cleaning fee of $250.00 will be charged to the Client in the event that any passenger vomits, spills bodily fluids, or causes any biohazard contamination inside any Black Elegant Transportation vehicle during the course of service. This fee is non-negotiable and non-waivable under any circumstances.

5.2 โ€” Fee Application

The $250.00 cleaning fee covers the cost of professional deep cleaning, sanitization, deodorization, and any lost revenue resulting from the vehicle being taken out of service for cleaning. This fee applies regardless of the severity of the incident.

5.3 โ€” Additional Charges

If the damage caused by vomiting or biohazard contamination exceeds the standard $250.00 cleaning fee โ€” including but not limited to damage to upholstery, carpeting, or other vehicle components โ€” the Client will be responsible for all additional costs beyond the base cleaning fee.

5.4 โ€” Authorization to Charge

By booking with Black Elegant Transportation, the Client authorizes Black Elegant Transportation to charge the payment method on file the $250.00 cleaning fee immediately upon the occurrence of any vomiting or biohazard incident during the service.

5.5 โ€” Chauffeur Authority to Terminate Service

โš ๏ธ SERVICE MAY BE TERMINATED IMMEDIATELY The chauffeur has full authority to terminate service immediately and without refund if a passenger vomits or causes a biohazard incident that renders the vehicle unsafe or unusable for continued service. In such cases, the $250.00 cleaning fee will still apply in addition to no refund being issued for the terminated service.

Passenger Conduct

6.1 โ€” Conduct Standards

All passengers are expected to conduct themselves in a respectful, lawful, and responsible manner at all times while in a Black Elegant Transportation vehicle. Black Elegant Transportation reserves the right to terminate service immediately and without refund if any passenger engages in behavior that is deemed unsafe, illegal, disrespectful, or damaging to the vehicle or chauffeur.

6.2 โ€” Alcohol Policy

Alcohol consumption is permitted in Black Elegant Transportation vehicles only by passengers who are 21 years of age or older and only in accordance with applicable state and local laws. Black Elegant Transportation reserves the right to refuse service to any passenger who appears to be excessively intoxicated or whose behavior poses a risk to the safety of other passengers, the chauffeur, or the vehicle.

6.3 โ€” Prom & Minor Passengers

โŒ ALCOHOL STRICTLY PROHIBITED โ€” MINORS PRESENT Alcohol is strictly prohibited in all vehicles when minors are present, including all prom transportation services. Any violation of this policy will result in immediate termination of service without refund. The Client and/or parent or guardian of minor passengers assumes full responsibility for ensuring compliance with this policy.

6.4 โ€” Smoking Policy

โŒ STRICTLY PROHIBITED โ€” MINIMUM $250.00 FEE Smoking, vaping, and the use of any tobacco or cannabis products is strictly prohibited in all Black Elegant Transportation vehicles at all times. Violation of this policy will result in a minimum $250.00 cleaning and deodorization fee in addition to any other applicable damage charges and immediate termination of service without refund.

6.5 โ€” Illegal Activity

Black Elegant Transportation vehicles may not be used for any illegal activity. The chauffeur is authorized to terminate service immediately and contact law enforcement if any illegal activity is suspected or observed. No refund will be issued in such cases.

6.6 โ€” Capacity Limits

The number of passengers in any vehicle must not exceed the stated maximum capacity of that vehicle at any time. Black Elegant Transportation reserves the right to refuse additional passengers beyond the stated vehicle capacity for safety and legal compliance reasons.

7

Service Terms

7.1 โ€” On-Time Guarantee

Black Elegant Transportation makes every effort to ensure on-time arrival for all scheduled pickups. However, Black Elegant Transportation is not liable for delays caused by traffic, weather, road closures, accidents, mechanical issues, or any other circumstances beyond our reasonable control.

7.2 โ€” Vehicle Substitution

Black Elegant Transportation reserves the right to substitute a vehicle of equal or greater value in the event that the reserved vehicle becomes unavailable due to mechanical issues, accidents, or other unforeseen circumstances. The Client will be notified of any substitution as soon as possible prior to the scheduled service.

7.3 โ€” Route & Additional Stops

The chauffeur will follow the most efficient route to the destination unless specific routing instructions are provided by the Client at the time of booking. Additional stops or route changes requested during service may result in additional charges based on time and mileage.

7.4 โ€” Overtime Charges

If the service extends beyond the reserved time, overtime charges will apply at the agreed hourly rate. The Client will be notified by the chauffeur before overtime charges begin where possible.

7.5 โ€” Wait Time

Black Elegant Transportation will wait up to 15 minutes beyond the scheduled pickup time at no additional charge. Wait time beyond 15 minutes will be charged at the applicable hourly rate.

7.6 โ€” Airport Pickups

For airport pickup services, Black Elegant Transportation monitors flight arrivals and adjusts pickup times accordingly for delayed flights at no additional charge. The Client is responsible for notifying Black Elegant Transportation of any flight changes or cancellations as soon as possible.

8

Payment Terms

8.1 โ€” Accepted Payment Methods

Black Elegant Transportation accepts all major credit cards, debit cards, and other payment methods as communicated at the time of booking.

8.2 โ€” Payment Authorization

By providing payment information, the Client authorizes Black Elegant Transportation to charge the provided payment method for all agreed-upon service fees, deposits, and any applicable additional charges including but not limited to damage fees, cleaning fees, overtime charges, and wait time charges.

8.3 โ€” All Sales Final

๐Ÿ’ฐ ALL SALES FINAL All payments made to Black Elegant Transportation are final except as outlined in the Cancellation Policy in Section 3. Black Elegant Transportation does not accept chargebacks or payment disputes as a substitute for the cancellation process outlined in these terms. Initiating a chargeback without first contacting Black Elegant Transportation may result in the Client being permanently banned from future bookings.

8.4 โ€” Disputed Charges

Any disputed charges must be communicated directly to Black Elegant Transportation within 7 days of the charge by contacting us at (636) 306-3058 or [email protected]. Black Elegant Transportation will make every reasonable effort to resolve disputes fairly and promptly.

Limitation of Liability

9.1 โ€” Maximum Liability

Black Elegant Transportation's maximum liability to the Client for any claim arising from the provision of services shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.

9.2 โ€” No Liability for Indirect Damages

Black Elegant Transportation shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services, including but not limited to missed flights, missed events, lost business opportunities, or emotional distress.

9.3 โ€” Force Majeure

Black Elegant Transportation shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, severe weather, government actions, pandemics, civil unrest, or infrastructure failures.

9.4 โ€” Personal Property

Black Elegant Transportation is not responsible for any personal property left in or damaged while in our vehicles. Clients are solely responsible for their personal belongings at all times.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Illinois. Any disputes arising from these terms or the services provided by Black Elegant Transportation shall be subject to the exclusive jurisdiction of the courts of the State of Illinois.

Acknowledgment

By booking, reserving, or using any service provided by Black Elegant Transportation, the Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions in their entirety.

The Client further acknowledges that they have had the opportunity to seek independent legal advice before agreeing to these terms and have chosen to proceed without doing so, or have obtained such advice and are satisfied with these terms.
